Short Sale/Foreclosure/Modify Oh My! What hurts your credit the most?

 What Will Hurt Your Credit more?

This is a question that I get all the time as a loan officer here in Arizona and despite the different laws in different states regarding the affects that a foreclosure or short sale can have on you personally,  the basic ramifications of the two are somewhat cut and dry when it comes to your credit.

The Drop-  This is the key to understanding what can happen to your credit with either one of these scenarios.  The rules for a foreclosure or a short sale are that you will take a hit of about 200 points with either one.  I have read conflicting reports that say a short sale will impact your score less than a foreclosure and I have heard that they are exactly the same.  Either way they are pretty close in how they affect your credit. 

Mortgage Loan Cola In Phoenix ArizonaSomewhat?- here is where the somewhat comes in to play.  FICO keeps their credit scoring models as about as secretive as Coca Colas secret recipe.  Fico gives you about the same amount of information as a can of Coke will give you on how it is made.  What will affect your score will depend on where you are currently at.  If you have a 750 plus credit score you can plan on seeing a possible drop of 150-200 points however if your credit is already lacking and you are sitting around 650 you may only see a hit of 85-105. Now if you are in the low 500's the impact will have even a less effect on your credit.  The problem is, most people who go into foreclosure or have a short sale have late payments pulling their score down to begin with so even that has to be taken in to account.

Why Not Modify?Home loan modification has been a route many consumers have turned to.  Last year FICO announced that at the current time there would be no change in credit scores when modifying until they had at least 1 year to understand the patterns of those modifying their mortgages.  I guess the honeymoon is up because I have started reading articles where those who have modified their mortgages have seen their scores drop up to 100 points. The reasoning behind this is due to the borrower not fulfilling the credit obligation as originally agreed upon in the beggining.

When it comes down to it plan on taking a bigger hit for the foreclosure and short sale than with the modification.  Don't forget that the late payments on your mortgage that comes with all these options will bring down your credit even further.

Venice FL Homes Market Update Report February 2010

Venice/Englewood Real Estate Market Update

The number of properties available for sale in the Venice/Englewood area real estate markets has decreased for the month of February, down 1.8% from January 2010; 3331 homes for sale to 3272 homes for sale.  Pending sales are up again, up 8.9% from January 2010; 514 properties pending to 560 properties pending.  Closed sales have increased from January 2010 by 24.5%, from 290 properties sold to 361 properties sold during the month of February 2010.  The increase in homes sold in the Venice FL area in February can be attributed to a variety of reasons; Buyers utilizing the First Time Homebuyers Tax Credit of $8000 and Move Up Homebuyers Tax Credit of up to $6500 or Buyers taking advantage of the most affordable Venice FL Home prices in decades.  Even though we have seen an increase in homes sold in Venice FL for 2010, we are still in a Buyers' Market.  The Homebuyers Tax Credit will soon be ending (you have to be under contract by April 30th to realize the $8000 First Time Homebuyers Tax Credit or the $6500 Move Up Credit and you do not have to have your primary residence sold before you buy your new primary home to utilize the Move Up Tax Credit).  Mortgage rates are rising, currently in the 5% range and soon is expected to increase to the 6% range, still historically low rates and very affordable for homebuyers.

Yikes! Fannie Mae is Cracking Down!

Via Mortgage Support Services:

There are some new rules going into effect shortly that will have an enormous effect on some mortgage transactions. Here's the biggest one:

Effective for all loan applications dated June 1, 2010 and later, Fannie Mae is "requiring lenders to determine that all debts of the borrower incurred or closed up to and concurrent with the closing of the subject mortgage are disclosed on the final loan application and included in the qualification for the subject mortgage loan."

Here's what it means. If a borrower opens a new account or increases the balance on an existing account between the time of application and the closing, the new debt has to be included. The best case is that the closing gets delayed. The worst case is that the borrower no longer qualifies for the loan and the deal is dead.

Fannie Mae provides the following "tips for lenders to consider" when attempting to find undisclosed liabilities. That's Fannie Mae Speak for "Do these things or else!"

- Refreshing a credit report just prior to closing may uncover additional debt or credit inquiries.

- Credit inquiries found on the credit report should be investigated to determine whether the borrower did in fact open additional debt resulting in repayment obligations. In some cases, it is possible to obtain a direct verification with the creditor associated with the inquiry.

- Fraud-detection tools are available through multiple vendors that assist lenders in identifying undisclosed mortgages or other potentially fraudulent scenarios.


Fannie Mae is not requiring these things until June 1, but lenders are allowed to implement them earlier. Many lenders probably will.

Be prepared! The mortgage industry has changed and continues to change. Being in the industry for 20 years means nothing if you don't stay up to date with all the changes. If your current lender has not already told you about these new rules, ask him why he hasn't. Maybe it's time to change lenders.
